UK Self Sponsorship Visa
Overview
The UK Self Sponsorship Visa is not a formal visa category.
It is a strategic approach within the UK’s existing immigration framework.
It allows individuals to sponsor themselves by setting up a UK business, obtaining a sponsor license, and then using that business to issue a Certificate of Sponsorship (CoS) for their own Skilled Worker Visa application.
This route is particularly appealing for entrepreneurs and professionals who do not have a direct job offer from a UK-based employer.
Furthermore, it offers certain benefits against the Innovator Founder Visa, which requires endorsement and meeting certain milestones.
Eligibility
The applicant is required to establish and own a legally registered business in the UK that complies with all applicable regulations and standards.
The company must apply for and secure a sponsor licence from the UK Home Office, allowing it to sponsor employees.
After obtaining the sponsor licence, the business owner can be sponsored by their own company as an employee under the Skilled Worker Visa.
Sponsor Licence | Requirements
You must have a genuine and compliant business that is registered in the UK in Companies House.
Your business must be able to comply with its sponsorship duties.
As a licensed sponsor, you must fulfil responsibilities such as recording and record-keeping duties while adhering to UK immigration laws, with the Home Office assessing your HR and recruitment systems for compliance and potentially conducting audits before or after granting your license.
Eligible Job Roles and Skill Levels:
Your UK business must offer a position that aligns with the skill level requirements of the Skilled Worker route, typically at RQF Level 3 or higher. Eligible roles are outlined in Appendix Skilled Occupations and Appendix Immigration Salary List, each associated with a SOC 2020 occupation code.Salary Requirements:
The proposed salary must meet the Skilled Worker route’s thresholds, generally at least £38,700 annually. Alternative thresholds of £34,830 or £30,960 per year may apply if the applicant qualifies for tradable points. Additionally, the salary must match or exceed the ‘going rate’ for the specific SOC 2020 occupation code or a percentage of the rate, based on the points system.Genuineness of the Role:
The position must be legitimate and fulfill a genuine need within your business. The job offered should not be a placeholder or intended for non-substantive purposes.Employer-Employee Relationship:
There must be a direct employment relationship between your company and the sponsored worker. While the individual can work overseas or be self-employed in certain cases, the arrangement should align with Home Office regulations.Restrictions on Hiring:
Sponsorship is not permitted for roles involving the deployment of the worker to a third party for routine or ongoing tasks. The employment must remain under the control and oversight of your business.
When applying for a licence, it’s essential to assign individuals within your business to oversee the sponsorship process.
The primary platform they’ll use is the Sponsorship Management System (SMS).
The key roles include:
- Authorising Officer: A senior, capable individual who ensures staff and representatives using the SMS comply with their responsibilities.
- Key Contact: Acts as the primary liaison with UK Visas and Immigration (UKVI).
- Level 1 User: Manages the daily operations of your licence through the SMS.
These roles can be held by a single person or distributed among multiple individuals.
The Authorising Officer must be either:
- Settled in the UK, or;
- British citizen
Required Documents
Business bank account
You must provide documentation that your business has an existing and current business bank account.
The bank must be regulated by the Financial Conduct Authority.
You must provide 3 documents from the following list:
- Documentation confirming the business’s operational premises, such as a property ownership deed or a signed lease agreement.
- Registration with HMRC as an employer for PAYE & National Insurance Contributions
- Latest annual accounts
- VAT Registration
- Employer’s Liability Insurance: must cover at least £5m.
